SC laments judicial delays, calls it a cause for Bihar public lynchings

Supreme Court has once again lamented the delays caused in disposing off the cases and recognized it as one of the primary reasons for the recent public lynchings in Bihar.

The court was dealing with a 60-year-old case when it observed that due to the delays in justice, people were fast losing faith in the judiciary, which is the reason why they are inclined to take law in their own hands!

The case in hand was an appeal arising out of a suit filed in 1947 in Kanyakumari in Tamil Nadu. Since the case had stretched for so long and the circumstances had changed, which had made it very complex to decide.

The Court, with the consent of the parties involved, decided that the property in dispute be equally divided between the parties. The court directed the district judge to decide as to which part of the property was to go to which party.

The Supreme Court further added that if any of the parties were not satisfied by the order passed by the district judge, it could approach the Supreme Court for further clarification.

Finally, the Court urged the authorities that all necessary steps be taken to reduce judicial delays so that the faith of the people in the judiciary and legal mechanism is not eroded.
